The following is a partial list of policies and procedures intended to provide our Customers a safe, friendly, efficient and effective atmosphere in which to achieve their fitness goals. It is not meant to be an all-inclusive list, but rather a reminder of some of the important daily protocols to be followed in conjunction with common sense and common courtesy.

All Customers are required to have their picture taken for access verification and security. Customers, guests, or family Customers must enter and exit from the main entrance. Customers must register with the front desk by scanning their ID key tag prior to using the facilities, at which point the front desk staff will verify the member’s photo on the computer. Replacement key tags are $3.00.

Guest privileges are permitted for those 18 years or older for a $15 daily guest fee. Management reserves the right to occasionally waive this fee in the interest of promoting the Facility and providing good will to its Customers. Guests are required to fill out the Guest Waiver and abide by all Facility Policies and Procedures.

Customers are urged to avoid bringing valuables onto Facility premises. Management, its affiliates, agents or employees shall not be liable for loss, theft, or damage to personal property of Customers or guests.

All Customers are expected to wear proper attire when using the Facility. Appropriate clothing and footwear must be worn at all times. Management reserves the right to decide what attire is appropriate and in the best interest of its Customers.

There is a 30-minute time limit on all cardiovascular equipment during peak hours.

Customers are required to bring their own locks. Lockers may not be used overnight. Items left overnight will be removed.

Customers are required to rack all weights and dumbbells immediately after use. Do not drop weights or dumbbells on floor.

Anyone requesting to “work in” on a piece of equipment must be allowed to do so. Please do not “tie up” multiple pieces of equipment.

Please do not drop weights in such a manner as to cause distraction to others working out. Also please refrain from the use of excessive verbal mannerisms (grunting) while lifting.

All gym bags and other personal belongings should be kept in a locker. These items present a tripping hazard when they are on the fitness floor.

Customers are not permitted to bring their own personal trainer. Only trainers on staff may train Customers at Mitch’s Market St. Gym.

Children under the age of 12 are not permitted up on the fitness floor. Children ages 12-15 years of age must go through an orientation prior to utilizing the equipment on the fitness floor. Children ages 12-13 years of age must be one-on-one with their parent working out in order to be permitted on the fitness floor.

The circulating or posting of petitions, notices, circulars, statements of any kind, or group protest or picketing is prohibited on the Facility premises unless previously approved by management.

Mitch’s reserves the right to remove any person when necessary without prior notice that is blatantly disregarding Mitch’s Policies and Procedures or House Rules or for any conduct which in the opinion of Management is prejudicial to the welfare, good order and character of Mitch’s Market Street Gym. Those individuals will be subject to suspension or termination of their Fitness Program privileges as per paragraph #7 of the Membership Agreement.

I agree to the amended Waiver and COVID-19 Member Resposibilities as described below:



I agree that I am personally responsible for my safety and actions while using Mitch’s Market Street Gym (Mitch’s Gym). I agree to comply with all Mitch’s Gym policies and rules, including but not limited to all Mitch’s Gym policies, guidelines, signage, and instructions.

Because the Mitch’s Gym is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19.With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the Mitch’s Gym, officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using Mitch’s Gym, or otherwise, while participating in any activity while in, on, or around Mitch’s Gym and/or while using any Mitch’s Gym facilities, tools, equipment, or materials.

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of Mitch’s Gym facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.3.

I acknowledge and represent that I have read the foregoing Waiver of Liability, understand It and agree to it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using Mitch’s Gym to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same.

I agree that this Wavier of Liability shall be governed by and construed in accordance with Pennsylvania law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall been forced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of t he Wavier of Liability as a whole. This waiver remains in effect until the State of Pennsylvania lifts all COVID-19 related mandates.

Customers are given these Policies and Procedures as a courtesy, understand the intent, and agrees to their terms and conditions. All members further agree to abide by all of Mitch’s Facility policies and procedures that may be posted at the Facility, issued orally or published, and which may be amended from time to time at Management’s sole discretion.
